Eligibility Update: More on Fukino; HI Could Allow Vital Records Access; Georgia Cops Busted on Obama Records Search; HR1503 Gets 10th Cosponsor
Numerous comments on this site and responses from around the blogosphere continue to come in regarding Hawaii Department of Health Director Dr. Chiyome Fukino’s latest statement on Mr. Obama’s vital records.
One such series of responses that a concerned citizen forwarded to me occurred over at the TexasDarlin blog, begun by a posting entitled, “Why Can’t Hawaii Officials Get Their Story Straight?” (lots more at the posting worth reading) by a commenter named “Joe the Blogger:”
Dr Fukino’s modus operandi is to send a press release to news outlets that are sympathetic to Mr Obama, knowing that they will spin her words to the maximum advantage of Mr Obama. In this way they get their ‘hit’ in first.
If you are very persistent you can find both of Dr Fukino’s ’statements relating to Mr Obama’s documents on the Hawaii.gov website;
If you search the site for Fukino + Obama you can find Dr Fukino’s notorious first press release ’statement’, dated 31st October 2008 (disguised under the date ‘December 26 2002′). This may not have been added to the Hawaii.gov website until AFTER I had made a Freedom of Information request for it. The url ishttp://hawaii.gov/health/about/pr/2008/08-93.pdf
The key statement is that “the Hawai’i State Department of Health has Sen[ator] Obama’s original birth certificate on record in accordance with state policies and procedures”. Dr Fukino doesn’t in fact claim, in this statement, that she has examined the original BC (as opposed to the RECORD of the original BC) – nor does she state the date or provenance of the BC. The statement is worthless, except as a useful propaganda tool for Mr Obama’s devoted followers to twist and exaggerate.The second press release ’statement’, dated 27th July 2009, cannot be found by searching for key words on the Hawai’i.gov website. “I, Dr. Chiyome Fukino, director of the Hawai’i State Department of Health, have seen the original vital records maintained on file by the Hawai’i State Department of Health verifying Barack Hussein Obama was born in Hawai’i and is a natural-born American citizen. I have nothing further to add to this statement or my original statement issued in October 2008, over eight months ago.”When one carefully examines these latest words, there is still plenty of room for wriggling.
Dr Fukino refers to ‘original vital records’. We are meant to assume that all of the records were generated in August 1961. Dr Fukino doesn’t state that. Why not? If she wanted to remove the doubts on this point, she should have stated the dates of ‘the original vital records’. Probably, some records do date from August 1961, but she has left open the possibility that some records were submitted after August 1961 – such as ‘corrections’, or ‘alterations’ or adoption(s) – all of which are specifically allowed for by Hawai’ian law. She may even be referring to some recently submitted ‘original vital records’, which Mr Obama himself may have sent in – perhaps with a covering letter explaining how he justifies his claim to be a ‘Natural Born Citizen’.
Dr Fukino states that she has seen these ‘original vital records’….’verifying Barack Hussein Obama was born in Hawai’i and is a natural-born American citizen’. She does not claim that the records have been examined and scrutinised in order to establish their provenance or reliability or veracity. Again – why not? Therefore, Dr Fukino’s words actually allow for the possibility that ‘the original vital records’ are false and/or contain falsehoods.
Dr Fukino uses the term ‘natural-born American citizen’. She does not state ‘Natural Born Citizen’ of The United States. So baby Obama was natural-born, that could even mean that he was born naturally, as opposed to being born by unnatural Caesarian section. [This is not intended to be an inflammatory remark about birthing procedures - it is intended to show that Dr Fukino's use of the term 'natural-born' (note with a hyphen) separated from the word citizen, by the adjective American, gives Dr Fukino plausible deniability in making her misleading claim]
Of course, as we have always acknowledged Barack Hussein Obama II may have been born in Hawai’i of an American citizen Mother. This obviously would make him a ‘United States citizen at birth’. If we assume that Dr Fukino is ALSO trying to assert that he is a ‘Natural Born Citizen’ within the meaning of The Constitution, then she must be implying that she fully understands the term and that she must have seen ‘original vital records’ verifying that BOTH of Barack Hussein Obama II’s parents were American citizens at the time of his birth. We know that Barack Hussein Obama I was never a citizen of The United States, so that opens the possibility that Dr Fukino has seen ‘original vital records’ verifying that Barack Hussein Obama II’s biological Father was not from British East Africa (now Kenya), but was instead some entirely different man, from America, such as Frank Marshall Davis – but lets not go there! [I accept that there is no evidence to this effect in the public domain, but my point is that Dr Fukino's words in her two press releases do not even rule out this possibility]
Dr Fukino may alternatively be just a ‘party hack’ and one of Mr Obama’s devoted followers. Also, she would have to be unbelievably inept at this stage, not to know that we have very sound grounds for believing that in order to be a ‘Natural Born Citizen’ of the USA, a child must be born in the Country of parents who are citizens. Of course, another alternative is that she is wilfully making a n assertion, regarding Mr Obama being ‘natural-born’, that she knows may not be true.
I agree with the many people who believe that the citizenship of Mr Obama’s Father is the crucial issue in assessing The Constitutional POTUS eligibility issue. It is patently obvious, for the reasons given above, that Dr Fukino has chosen to AVOID that issue in her press release of yesterday.
We still need to see the original 1961 long-form Birth Certificate, and ALL of the other documents in the Hawai’ian files, in order to tie up all of the loose ends that I have mentioned above. It may be that Mr Obama knows of some information in there that would undermine his carefully contrived life story. The existence of such information would put him at risk of being blackmailed and therefore make him a security risk.
It might well transpire that this is all part of the end-game of Mr Obama’s people – that having built up the Birth Certificate issue into the biggest monolith possible, they will then totally obliterate it and everyone on it or near it, by releasing the original long-form Birth Certificate. They would then hope that the main issue of Mr Obama’s dual-national, non ‘Natural Born Citizen’ status and therefore the issue of his Constitutional ineligibility to be POTUS, would also be buried forever.

Since when is it the authority of the Hawaii Dept. of Health to make that determination? That’s in the jurisdiction of courts.
Hawaii Dept. of Health officials only have the authority to state what is in their records. They do NOT have the authority to interpret the legal meaning of those records.

Now, suddenly, not only can they tell us that he was born in Hawaii, they can make legal pronouncements of Constitutional import.

It’s good practice to take a person at his word until someone shows you proof he is lying.
Barack Obama says he was born in Hawaii, and since no one has shown any proof he was born in Kenya or elsewhere, it’s OK to conclude he was born in Hawaii.
Sure his grammar school records show that he was enrolled as an Indonesian Muslim, but some people will say anything to get their kid in the right school. It doesn’t really answer the question.
It’s OK though for others not to use my deferential standard and continue to question whether Obama was born in Hawaii. We aren’t talking about a 12 year old qualifying to play Little League here. There is a Constitutional mandate that the President be a natural-born citizen, and if Obama is not one, he certainly will have committed the biggest fraud since the White Sox threw the World Series.
The reason why people still question Obama’s citizen status is one-fold: “President Transparency” has refused to release any original documents on the matter. He can end the controversy in a day by releasing original documents, but for some inexplicable reason he refuses, and his love-struck media never asks him why he won’t. The media instead spends hell-bent hours on making the Birther movement look like fringy, conspiracy-hungry kooks.
You have to admit though, even if you are a devout Obama-bot, Obama’s refusal to release any original documents makes for a newsworthy story by itself.
If he really wants the Birthers to shut up, he has the power to do it by releasing the original documents. Why not just do it then? It’s a simple task. Why not get rid of a conversation that has been with America since the campaign? …

Regarding accessing vital records in the great State of Hawaii, someone pointed out that apparently the State Legislature could soon be taking up a measure allowing birth records to become public record (via StarBulletin.com):
…The issue is not likely to go away, and Hawaii state Sen. Will Espero said he would introduce legislation next year to have birth certificates declared public records.
Espero (D, Ewa-Honouliuli-Ewa Beach) said the Obama fuss has raised questions about public and private records and says it would be in the state’s interest to have open public record of births.
“It would be important for relatives and even neighbors,” Espero said.
CitizenWells picked up the story from down here in the great State of Georgia that a couple of DeKalb (pronounced “de-CAB”) County police officers ran a background check on Mr. Obama:

“Two DeKalb County police officers have been placed on paid administrative leave after an investigation revealed they ran a background check on President Barack Obama.
A representative for the DeKalb County CEO’s office identified the officers as Ryan Wright and C.M. Route.
Officials said Obama’s name was typed into a computer inside a DeKalb County police car on July 20 and ran through the National Crime Information Center.
The secret service was immediately notified and contacted the DeKalb County Police Department.”

As WSB-TV Channel 2 remarked concerning this incident:
It is unclear why the officers ran a check on the president.
Under normal circumstances, my understanding is that law enforcement personnel are prohibited from running any sort of checks against individuals without due cause. It will be interesting to find out exactly why these officers ran a check against the President.

Applying the 14th Amendment as constructed, Obama was not a US citizen “at birth”. If you are not a citizen of the US the only way to become one is to apply for citizenship to become a naturalized citizen.
If he is a naturalized citizen, perhaps those records are also sealed.

If you take the phrase, “and subject to the jurisdiction thereof;” from Section 1 of the 14th Amendment, Obama would “at birth” be a United States citizen.
However, that phrase is still there.
The word “jurisdiction” as used in the 14th Amendment means total jurisdiction. It was defined such by the framers, also in Steel Co. v. Citizens for a Better Environment (1998) and prior to that by the Attorney General of the United States in 1873.
Obama was a citizen of the UK at birth and remains so unless he renounced that citizenship and became a naturalized citizen.

Obama seals all records throughout life and media does not report. Two officer in George check Obama background, and placed on leave, and it hits the news. The criminal complaint filed by a retired naval officer seems forgotten. Could the media be sending a message across the nation that if you check out Obama, you will be horsemeat? The statements are formally located on a State-based web site (which is quite obviously far more than can be said about Mr. Obama’s alleged COLB). Therefore, chances are very good that they are legitimate.

I find it rather curious that of the two PDF “News” releases from the Hawaii DEPARTMENT OF HEALTH neither one contains a signature. So, how are we to say with certainty that those documents originated from Fukino/Lingle’s office? Those PDF are no more of claim to legal positions than the ridiculously inept, infamous COLB document.

I guess the most amazing turn of events for me is the conservative media’s wholesale demeaning of “birther” claims. I have to wonder how the “good guys” can now be trusted any more than the state-run media types. O’Reilly’s cavalier and arrogant assertion that the issue is “bogus” causes me to view him and some of his other traditionalist colleagues with considerably less respect. ONe has to now wonder how professional and thorough their researchers really are, not only on this topic but on a whole host of other seminal topics as well.
