Censorship: CNN Scrubs YouTube Video; Demands Blogger Remove Own Follow-Up Video; Update: Kathy Barkulus on Fox & Friends
Following up on CNN’s journalistic hit-job on the April 15 tea party, WorldNetDaily is now reporting that CNN wants FoundingBloggers.com’s follow-up video of concerned citizens questioning reporter Susan Roesgen’s just-wrapped segment to remove their footage:
Cable television news network CNN has attempted to block a video on YouTube.com that shows “tea party” protesters in Chicago confronting the network’s reporter Susan Roesgen over her allegedly biased and “not fair” coverage of the event.
Members of Founding Bloggers.com were on hand to videotape the crowd’s response to Roesgen’s report, in which she badgered protesters on air, summarizing her report by describing the tea party as “anti-government, anti-CNN, since this is highly promoted by the right-wing, conservative network Fox.”
Roesgen’s report included arguments with the tea partiers, tossing out contrary positions and demanding her subjects justify their positions, as well as an antagonistic interview with a protester whose sign read, “Obama is a fascist.” …
When the blog posted the video on YouTube – showing a portion of Roesgen’s report, followed by its own footage – however, the clip was scrubbed and replaced with the message, “This video is no longer available due to a copyright claim by Cable News Network, Inc.” …
News of CNN squelching the video in a copyright claim, despite the majority of the video consisting of original Founding Bloggers material, quickly spread through the blogosphere.
“It is hard to avoid the inference that in this case,” writes John H. Hinderaker of the Power Line blog. “CNN was motivated not by a desire to protect its intellectual property but by a desire to avoid embarrassment caused by the unprofessional performance of its reporter.”
“Obviously we hit a nerve with CNN because they forced YouTube to pull the video down, along with all of the comments people posted,” Founding Bloggers responded. “We are in the process of consulting our Founding Bloggers legal team to decide if we are going to file a counter claim against CNN. We believe that we are well within our rights under fair use, but we are not attorneys so….we’ll see.”
Ben Sheffner of the blog Copyrights and Campaigns, however, is an attorney who has served as a copyright advisor to NBC Universal, Fox and the John McCain campaign.
“CNN does own copyright in its own news footage and, as a general matter, has the right to demand its removal from YouTube,” Sheffner writes on his blog. “However, as to this particular video, I think Founding Bloggers has a very strong fair use defense. The purpose for Founding Bloggers’ posting of the CNN footage is crystal clear: to comment on and criticize CNN’s reporting on the ‘Tea Party.’ Such a use is right in the heartland of the fair use doctrine; the statute specifically mentions ‘criticism, comment, [and] news reporting’ as protected uses that are ‘not an infringement of copyright.’”
Sheffner adds, “Many fair use cases are difficult, close calls – but, given the facts as I know them, this is an easy one. … I’m surprised CNN made this claim in the first place.”
WND attempted to contact CNN for comment, but no one was available to speak during weekend hours.

In any case, it is hard to understand why YouTube also took down the 3000+ comment thread from the video. Does CNN own all discussion of this clip???

May I recommend something to you folks at CNN? Try a statement such as the following:
“We regret that so many were offended by the reporting of one of our journalists at the Chicago tea party event. It was our intent to provide reasonable coverage of the protests and it was unfortunate that our viewers were not able to see other reports which we did in other cities.”
Surely you would see that this is quite a legally apologetic comment. You’re not really apologizing, but you come across as at least addressing the situation and giving yourself the ability to move on without having to truly address the real issue.
Nevertheless, it is quite clear that the venerable blogosphere has matured to the point of causing even cable stalwart CNN some heartburn.
This cannot be a bad thing.

I think Susan should find another type of work and an apology is in order from her news company.
No way, no how should any news media be allowed to agrivate a peaceful demonstration. Susan should have been taken in by law enforcement for agrivated assault.
News media need to go back to school and realize they are there to report the news, not to demonstrate their bias in an agrivating way. Let the viewers decide…

The one thing to remember about all this is that it is not working. Gingrich just finished slamming the imposter this morning all over the main stream news regarding the imposters handshake with chavez. The imposter in the white house does not represent a majority of the people. He does represent the criminals in the US. He is and was involved in voter fraud with the assisstance of acorn. He does have ties to criminals (Blagojevich et al). He is being investigated for impeachment proceedings behind the scenes. He is invovled in disinformation tactics. He is a criminal himself as he is accepting a paycheck from taxpayers hard earned money and is making usufruct of air force one. He has accepted bribes from foreign emmissaries. The imposter has links to Sadam Hussein. The imposter is trying to imitate hitler in his thirst for power. cnn is going to try to sell more airtime with regards to making preposterous claims about ‘bama’s achievements with a big 100 day in office celebration. Last I saw home forclosures were at an all time high this is not a very good achievement. Thanks for tuning in and I will return with more good news about the failure of this administration…

Good News,your video belongs to you and only you in it’s entirety!
The statement of the attorney for NBC is a conflict of interest to begin with as he has or does work for CNN and or NBC so he’s going to do his best to present/protect their side of the STORY as he/they want! Emphasis added with intent to show that what you photographed/videoed was also a STORY albeit not one CNN is to pleased about but a STORY none the less! This added tidbit happened while you were photographing the Tea Party and everyone involved so you captured this too! Why not, it was part of the event and is every bit as much News Worthy, probably even more so, than that of what CNN crews captured.
As a professional photographer the issue of copyright infringment is always of concern especially when photographing a specific individual without their permission but that was not the case nor your entent but as the CNN reporter made such scene at this Tea Party that you also were capturing, her actions are the frosting on the cake, so to speak, as they are very news worthy in and of themselves and News Worthy Photographs are the property of the individual doing the actual photographing or the organization he works for depending on their agreement. Most certainly not the property of some other news group. To further exemplify my point, the photographs/video CNN shot of the Tea Party does not give them the right to claim the event as belonging to them and that is what they are attempting to try and sell you folks on that your video of their individual belongs to them and it most certainly doesn’t!
Being that you were photographing/videoing all the various people at the event and I’m sure even groups of people it was not your intent to single out one specific individual more than another and I’m quite sure even the shots you took of this particular lady also, at least for the most part, included other individuals and the Tea Party in it’s entirity to the best of your ability..
To get technical, the latent image as captured, even going back to the days of film, belongs to the photographer even before it is developed [film] so any images captured by whomever belongs to them especially of news worthy items in public places and the Tea Party was most certainly that as well as the CNN reporters actions. After all it was her that was making a spectectal of herself in a public place and you were capturing a public event!
