WND: Ex-Officer Visited by Law Enforcement Over Criminal Complaint
As had been previously reported here, the blogger Walter Francis Fitzpatrick III, a retired Navy officer, had received a visit by law enforcement officers over a letter he sent to the US Attorney’s office for the Eastern District of Tennessee. WorldNetDaily followed up on this story and revealed the following:
An ex-military officer has raised the stakes in the ongoing dispute over Barack Obama’s eligibility to be president, filing a criminal complaint against the “imposter” with the U.S. attorney’s office for the Eastern District of Tennessee.
Retired U.S. Navy officer Walter Francis Fitzpatrick III, who has run a campaign for two decades to uncover and try to correct what he believes are criminal activities within the military, accused the president of “treason.”
In his complaint addressed to Obama via U.S Attorney Russell Dedrick and Assistant U.S. Attorney Edward Schmutzer, Eastern District, Tennessee, Fitzpatrick wrote: “I have observed and extensively recorded invidious attacks by military-political aristocrats against the Constitution for twenty years.
“Now you have broken in and entered the White House by force of contrivance, concealment, conceit, dissembling, and deceit. Posing as an impostor president and commander in chief you have stripped civilian command and control over the military establishment.”
He cited the deployment of “U.S. Army active duty combat troops into the small civilian community of Samson, Ala.,” and said, “We come now to this reckoning. I accuse you and your military-political criminal assistants of TREASON. I name you and your military criminal associates as traitors. Your criminal ascension manifests a clear and present danger. You fundamentally changed our form of government. The Constitution no longer works.
“I identify you as a foreign born domestic enemy,” he wrote.
The 1975 graduate of the U.S. Naval Academy in Annapolis told WND that a short time after his complaint was filed he was visited by two U.S. Secret Service agents, but they left after telling him they perceived no threat to the president in the document.
Officials with the Knoxville office of the Secret Service told WND the only person who could release information to the media was on vacation and they would not comment on the issue.
Likewise, officials with the U.S. attorney’s office declined to respond to a WND request for a comment.
Fitzpatrick told WND the U.S. Justice Department needs to look into the issue. …
Fitzpatrick said he has devoted his career fulltime to investigating issues in military justice and defending wrongly accused soldiers, sailors and Marines. His own career was torpedoed by a court-martial more than 20 years ago over his authorization of the use of a ship’s fund to sent an officer to the funeral for his brother, who had been killed by terrorists.
Fitzpatrick’s situation has been described not only on his own website but forum pages on other websites that deal with military issues.
He alleges his case was fabricated and even his signature was forged by officials connected to his case. He points to the fact that he ultimately retired and was awarded a militarypension as support for his allegations.
But he says the new complaint against Obama should define the issue of the president’s eligibility.
“They either have to come and get me or get Mr. Obama’s eligibility proved. He has an officer in his military saying he is guilty of trespass on the Constitution,” Fitzpatrick told WND.
“They can recall me against my will to active duty,” he said. “I would refuse. It’s an illegal order by a man who is not by commander in chief.” …
Hawaiian officials have confirmed they have a birth certificate on file for Obama, but it cannot be released without his permission, and they have not revealed the information it contains.
John Eidsmoe, an expert on the U.S. Constitution working with the Foundation on Moral Law, has told WND a demand for verification of Obama’s eligibility appears to be legitimate.
Eidsmoe said it’s clear that Obama has something in the documentation of his history, including his birth certificate, college records and other documents that “he does not want the public to know.”
Officials for the Obama campaign repeatedly have refused to comment on the questions, relenting only once to call the concerns “garbage.”
WorldNetDaily and one of my sources have similarly reported that attorney Stephen Pidgeon, litigant for the Plaintiffs in Broe v. Reed, is currently being cased by law enforcement officers. I have also reported on another private citizen who sent a letter to Judge Robertson (apparently requiring a check by law enforcement as well) as a part of my posting on the President’s power consolidation.

Obviously the DNC can’t spell and maybe you can’t see it, but the document clearly says “Certification of Live Birth”-not the same as
a “Certificate of Live Birth”-in form or in truth.

Incidentally, I’ve been looking into this quite a while and can state with some confidence that Barack Obama is the only U.S. president to produce his birth certificate in the course of attaining the presidency. If I’m mistaken, please, someone, cite where one of the other 43 presidents offered his birth certificate as Obama did.
I don’t know why he doesn’t show his school records. I know why I do not show mine and my reasons lead me to regard it as a legitimate issue of privacy. That’s just me. How much a candidate has to show to win your vote is entirely up to you.
Anyone who actually wants to know where President Obama was born can find out within half a minute, assuming they have decent Internet access. If they have to call or go to the library it could be several minutes. It might even take an hour or so if they live in the boonies or at the library there’s a line.
Reality: The evidence is conclusive; the matter is decided. Questions do not remain open just because some people refuse to face the answers.
If I’m not mistaken, I believe now that a CRIMINAL case has been filed, the burden of proof is now on the defendant.
So now, won’t Obama have to provide proof of eligibility or face criminal conviction?

Rrobin, it appears you are mistaken, in a criminal case the burden is squarely on the accuser, it is even a greater burden than in a civil case (proof beyond reasonable doubt as against proof by preponderance of evidence) so the law enforcement will first investigate & if they feel there’s a prima facie case give it to the prosecutors office to see if a criminal case has been made then it is taken to court. The standard of proof required here will be proof beyond reasonable doubt & the burden of proving is squarely on the accussers.

All the allegations against Obama are based on suspicion & not evidence, how do i know this, well everyone making allegation are ALL (except maybe Don Leo) requesting for Obama to produce or permit them to get some documents to prove these allegations, so, so long as he doesnt produce or permit the production of these docs the accusers cant prove their cases. So its not factual true that there is a mountain of evidence but a mountain of suspicion.

If you believe his version of the events of why he was court martialed, then I have an original copy of Obama;s Keyan birth certificate to sell you.
And his seemingly never ending crusade against the military justice system since and we have an axe grinder.
Being the daughter of a 32 yr career Navy man, I understand what he is talking about. My own father told me of actions done to them by the Navy. These things were also done to my father, unfortunately they were not told to me until he was on his death bed, brought about by the US NAVY.
Our troops are our heros regardless of what the DOD does. These men and women volunteer for service, really not knowing what they are headed for. I saw that myself when my youngest son was being wooed by the Navy. They made him promises for his signature and when all was said and done, those promises never existed.
I applaud Fitzpatrick for his honesty trying to bring this about and wish him to best of luck.

Mr. Fitzgerald should be aware that as a retired member of the military receiving retirement pay, he is subject to the provisions of the UCMJ, including Article 88:

Why doesn’t Obama just show his birth certificate and school records. If he is a citizen then he should have no problem showing his records. Why would he risk the scorn of the Military, after all these brave people might die from his orders. If he won’t show these documents then I have to believe that he is not a citizen of the US and he is an imposter. It is really simple for him to clear this up but for over a year he has not. Instead he has let it grow until hundreds of thousands are demanding something be done here.
Thinking out loud here, an individual doesn’t initiate a criminal case like they would a civil one. Although they can file a criminal complaint, it requires an appropriate government official to begin criminal prosecution, so there’s no burden on anyone (save the person filing the complaint) to show anything until then.

It seems Law Enforcement is is doing what they do best, making the general public fear them instead of protecting the public that they are paid to serve. Public servants???
The closer anyone gets to the truth the more law enforcement will put fear into the public.
