OH State Rep Offers Joint Resolution Asking Electoral College to Confirm Citizenship

COLUMBUS — A state lawmaker is urging Electoral College members to confirm the president-elect’s citizenship before casting their ballots next week.

Rep. Diana Fessler, a Republican from west-central Ohio, offered a joint resolution Thursday, during the House’s nonvoting session, calling on electors “to exercise due diligence to ensure that the persons for whom they cast their ballots for president and vice president of the United States are citizens of the United States.”

The resolution, which won’t be acted on by the chamber prior to next week’s vote, also calls for electors to examine “birth certificates of those persons” and that copies of the resolution be distributed to the governors and Electoral College members in all 50 states.

Ohio’s Electoral College will convene Monday at the Statehouse, with 20 Ohioans expected to cast their ballots for President-elect Barack Obama and Vice President-elect Joe Biden.

Fessler’s resolution is in relation to ongoing conspiracy theories alleging the president-elect is not a natural born citizen and is ineligible to serve as the nation’s chief executive.

Legal filings on the issue have been made, and the U.S. Supreme Court earlier this month quashed one related lawsuit.

I am tracking other State-based electoral reform initiatives and who’s responsible for properly vetting candidates. I see this as a long-term proposition to pursue, as America’s electoral system — especially at the State level — sorely lacks fundamental enforcement mechanisms.

Update: The Dayton Daily News adds the following (in part):

Fessler said that she didn’t expect a vote on the resolution before members of the Electoral College in Ohio and other states cast their ballots on Monday, Dec. 15.

She said she had “several phone calls” on the issue, urging her to act.

“I don’t know that it will change anything,” she said. “I have responded to the best of my ability.” She said she had no “first-hand knowledge” of Obama’s citizenship. …

Fessler said that members of the Ohio House have to show proof that they were elected by providing “official paperwork.”I thought it was a good parallel,” she said of her resolution.

She said due diligence should be exercised “not just in this case but in all cases.”

    I spoke with Diana Fessler about the issue also on Friday the 19th of December. She is standing up for the Constitution and to put a law in place to avoid this confusion as to who is required to vet the Candidates it should be The Secretary of State. Any ways thank you Representative Fessler for standing up.

    I agree, its probably just the begining. Hopefully enough pressure will build and SCOTUS will have to address this issue.

    If I may interject, a recurring theme I have noticed in the mainstream media is that “this isn’t going away,” hence part of the reason why they’re reluctantly covering it.

    I was very impressed with Diane Fessler. We had a very good discussion and she asked excellent questions I believe she was truly unaware of the depth of this issue.

    Many people are not aware of the constitutional distinction between citizen and natural born citizen. I do not feel she tried to mislead anyone. Don’t beat up on her, she is on our side.

    She told me that her resolution would not be acted on before the electoral college vote and may not be acted on at any time. I think the Democrat electors don’t really care about this issue, they are going to vote for BHO regardless.

    I’m sure the next wave of lawsuits will be against the electors for voting for an unqualified candidate.

    So who’s going to demand anything – and AFTER they vote? How convenient. Unless they establish some standing for requiring the BC to be presented – probably through the courts – Obama will just continue to stall. Unless the Court acts to delay by tomorrow it’s like an unstoppable locomotive. It’s more likely to get attention through disgruntled libs/progressives who are now seeing their “change” man giving them policies that are actually 4 more years of Bush! If that continues then they might do a turnaround in the Obama beloved press. Let the circus begin!

    There should also be a “stop gap” strategy in notification of each set of Senators and your District Representatives (that is 3 e-mails or letters) essentially stating the following:

    Dear ____________

    1.You took an Oath of Office to uphold the Constitution.
    2.The Constitution Art. II requires that the President be a “Natural Born Citizen” as opposed to a “Citizen”
    3. A Natural Born Citizen is a person born of Citizen parents within the jurisdiction of the US.
    4. It is an uncontested fact that Mr. Obama is admittedly not a “Natural Born Citizen” as his father was a citizen of Kenya at the time of the Candidates birth.
    5. On Jan 6, you may be asked to confirm the Electoral College Votes for Mr. Obama pursuant to the Constitution
    6. If you fail to object to the confirmation at that time you will be knowingly and deliberately violating your Oath and the Constitution and may be subject to legal liability for such a knowing violation.
    7. The Constitution is the Law unless legally amended and cannot be abridged for whim, convenience or popular sentiment as to do so would effectively render our Nation without law as any other provision could then be ignored with impunity.

    We respectfully request that you uphold your Oath of Office.

    Still missing the point-making sure the candidates are “Citizens”????-how about “Natural Born Citizens”??? The issue is that Senators etc., may be “Citizens” but the President and Vice President must be “Natural Born Citizens”!

    you might want to inform Diana Fessler, that she should call on Electors to examine whether candidates are NATURAL BORN CITIZENS.

    Mrs. Fessler seems to have been mislead much much of the press, in thinking there is only one controversy, that about the existence of Obama’s birth certificate.

    The electors should be contacted to let them know there are many of us who are very concerned they could be casting their vote for a Constitutionally unqualified candidate leaving us in a very real Constitutional crisis.
