Electoral College: Elector Statutes, Responses to the Law, Ineligible Electors?

Submitted by Phil on Tue, Dec 2, 2008One Comment

CitizenWells posted an article today discussing a brief history of the Electoral College, the role of States in the process, some examples of various State statutes, and some very ignorant responses from public officials.

And, believe it or not — as blogger Sibby Online also posts today (WorldNetDaily is referenced as well) — it is very possible that some unknown number of Electors who are delegated the responsibility of officially voting for the President-elect are ineligible, to the point of being… well, dead!

In her posting, she mentions that Gary Kreep of the United States Justice Foundation and lead counsel for Keyes v. Bowen is moving forward on (in this case) having the California Secretary of State office canvass the State to thoroughly investigate this shocking finding.

So, let’s walk through this. We have party officials who are telling various Secretaries of State that Barack Obama is, in fact, certified as being eligible for the Presidency. Then, we have certain Secretaries of State continually passing the proverbial buck and claiming “no enforcement” when American citizens take them to court over questions of eligibility (see my Categories section, 2008 Election, for a complete listing of lawsuits). And, through it all, once 5 of these cases have actually made it to the Supreme Court (and cases like Donofrio v. Wells make it all the way to an impending 9 Justice conference), nobody in the media seems to want to cover anything that’s going on.

Are we seeing the beginnings of a political disaster on our hands?

It’s not that the system, per se, is bad, but what’s the point of having laws if nobody is going to actually step up and enforce them?

Update: yourfellowcitizen.com wrote a great piece on Alabama’s very specific statutes regarding candidate eligibility. It is based on a letter written to the Honorable Jean Brown, Chief Legal Council at the Alabama Secretary of State’s office. And DeathByAThousandPaperCuts just posted a piece this morning asking the question, “Who Determines Presidential Constitutional Eligibility?

  • TV News says:

FOX reported very briefly that Donofrio’s suit will be considered Friday in a conference of the 9. So its beginning to trickle down from Pravda to the MSM….:-))
